BE IT RESOLVED, that the County Administrator be authorized to negotiate Agreement PW 36-84-23 with Burlington Northern Santa Fe Railway for construction of a new concrete crossing surface on County State Aid Highway 9 (42nd Avenue) west of West Broadway (CSAH 8) in the city of Robbinsdale (CP 2183557), at an estimated county cost of $90,000; that upon review and approval by the County Attorney's Office, the Chair of the Board be authorized to sign the agreement on behalf of the county, and that the Controller be authorized to disburse funds as directed.

Background:
Burlington Northern Santa Fe Railway (BNSF) operates a freight transportation system serving the Minneapolis and St. Paul area. BNSF's tracks cross the county highway at 42nd Avenue west of Broadway Avenue in the city of Robbinsdale. The crossing surface has deteriorated and has been identified as needing replacement.
BNSF will install a new concrete crossing surface at a width of 90 feet on 42nd Avenue in 2023. The new crossing surface will adequately cover all vehicular driving lanes and sidewalks.
Funding for the project is available in the CP 2183500 - Cost Participation and Partnerships 2019-2023, with expenses tracked in its associated subproject CP 2183557 - 42nd Avenue Railway Crossing.
