BE IT RESOLVED, that a quit claim deed conveying the Hennepin County Regional Railroad Authority’s interest, if any, over that part of the following described property: Lots 5 and 12, Block 6, Lindley & Lingenfelters Addition to Minneapolis, according to the recorded plat thereof, Hennepin County, Minnesota; The vacated alley adjacent to said Lots 5 and 12 dedicated in said plat of Lindley & Lingenfelters Addition to Minneapolis; Vacated Nicollet Ave. adjacent to said Lot 5 dedicated in said plat of Lindley & Lingenfelters Addition to Minneapolis; Vacated Nicollet Ave. adjacent to Lot 25, Block 4, “Boulevard Addition to Minneapolis”, according to the recorded plat thereof, Hennepin County, Minnesota, as dedicated in said plat; Vacated 29th Street dedicated in said plat of “Boulevard Addition to Minneapolis”, lying westerly of the northerly extension of the east line of said Block 4; all lying southerly of a line 40.00 feet northerly of and parallel with the north line of said Block 4 and its extensions, to City of Minneapolis, at no cost, be approved; and that the Executive Director and Chair be authorized to sign the deed and related conveyance documents on behalf of the authority; and
BE IT FURTHER RESOLVED, that the acceptance of a quit claim deed conveying City of Minneapolis’ property interests, if any, over that part of the following described property: Lots 5 and 12, Block 6, Lindley & Lingenfelters Addition to Minneapolis, according to the recorded plat thereof, Hennepin County, Minnesota; The vacated alley adjacent to said Lots 5 and 12 dedicated in said plat of Lindley & Lingenfelters Addition to Minneapolis; Vacated and unvacated Nicollet Ave. adjacent to said Lot 5 dedicated in said plat of Lindley & Lingenfelters Addition to Minneapolis; Vacated and unvacated Nicollet Ave. adjacent to Lot 25, Block 4, “Boulevard Addition to Minneapolis”, according to the recorded plat thereof, Hennepin County, Minnesota, as dedicated in said plat; Vacated 29th Street dedicated in said plat of “Boulevard Addition to Minneapolis”, lying westerly of the northerly extension of the east line of said Block 4; That part of the Southwest Quarter of the Southeast Quarter of Section 34, Township 29, Range 24 embraced within HENNEPIN COUNTY REGIONAL RAILROAD AUTHORITY PROPERTY MAP NO. 34, according to the recorded map thereof, Hennepin County, Minnesota, lying westerly of the northerly extension of the east line of said Block 4; all lying northerly of a line 40.00 feet northerly of and parallel with the north line of said Block 4 and its extensions, this Quit Claim Deed is not intended to, and does not, release any of Grantor’s easement rights it received by that certain “Bridge Agreement (1st Avenue South Bridge)” recorded with the County Recorder in and for said Hennepin County as Document No. {insert Document No. of “Bridge Agreement (1st Avenue South Bridge)” recorded prior to the execution of this Quit Claim Deed} or any public easement for Nicollet Avenue, to Hennepin County Regional Railroad Authority, at no cost, be approved; and that the Executive Director and Chair be authorized to sign acceptance on the deed and related conveyance documents on behalf of the authority.

Background:
The City of Minneapolis plans to reconstruct the Nicollet Avenue bridge over the Midtown Corridor, as well as redevelop the former Kmart site on Lake Street. During site assembly, title inconsistencies were identified along the south property line of the Hennepin County Regional Railroad Authority (HCRRA) Midtown Corridor. As a remedy, HCRRA proposes to grant a quit claim deed to Minneapolis over the area in question in exchange for a quit claim deed from Minneapolis to remove any rights that the city has over the HCRRA corridor adjacent to the area. The deed exchange will create a uniform property line on the south side of the Midtown Corridor between Blaisdell Avenue and First Avenue South.
Current Request:
Approve exchange of quit claim deeds conveying rights between HCRRA and the City of Minneapolis to correct title inconsistencies on or adjacent to the Midtown Corridor.
Impact/Outcome:
Approval of this request will allow a quit claim deed exchange with the City of Minneapolis to resolve title inconsistencies and make a uniform south property line on the Midtown Corridor between Blaisdell Avenue and First Avenue South.
