BE IT RESOLVED, that the Amendments to the following Agreements with county jails or correctional facilities to temporarily board Hennepin County detainees, extending the end dates to December 31, 2027, and increasing the combined not to exceed amount of $12,059,613, be approved; that the Chair of the Board be authorized to sign the Agreements on behalf of the County; and that the Controller be authorized to disburse funds as directed:
• PR00003848 with Washington County, Amendment 1 increasing the not to exceed amount by $1,438,172 for a new not to exceed amount of $1,669,172;
• PR00004798 with Carver County, Amendment 1 increasing the not to exceed by $431,452 for a new not to exceed amount of $611,452;
• PR00004799 with Chisago County, Amendment 2 increasing the not to exceed amount by $719,086 for a new not to exceed amount of $1,262,086;
• PR00005672 with Wright County, Amendment 3 increasing the not to exceed amount by $2,157,258 for a new not to exceed amount of $6,068,258;
• PR00006216 with Scott County, Amendment 3 increasing the not to exceed by $1,380,645 for a new not to exceed amount of $2,448,645; and
BE IT FURTHER RESOLVED that decisions regarding annexing detainees will prioritize:
• Proximity to Hennepin County;
• Court process (e.g., awaiting court-ordered assessments, evaluations, pre‑sentence investigations, access to counsel);
• Continuity of services offered to detainees (e.g., mental health treatment, health services, family access and stability, language supports); and
• Total costs related to annexation, transportation, and/or staffing.

Background:
Pursuant to Minn. Stat. §387.11, it is the responsibility of the Hennepin County Sheriff to ensure that detainees in custody are kept safe and secure. Contingency plans have been developed to meet responsibilities to detainees in custody. These Agreements may be activated when portions of the Hennepin County Adult Detention Center (ADC) are closed for maintenance and repairs, or when detainee population counts exceed approved capacity.
On December 3, 2024, Resolution 24-0520 authorized the negotiation of amendments to annexing agreements with seven Minnesota counties: Anoka, Goodhue, Ramsey, Sherburne, Chisago, Scott and Wright, to address the required reduction of the ADC’s detainee population. The agreements with Anoka, Goodhue, Ramsey, and Sherburne have since expired, and no renewals or extensions are being requested.
On May 20, 2025, Resolution 25-0210 authorized the negotiation of amendments to annexing agreements with Scott and Wright Counties to address additional reductions of the ADC’s detainee population.
To date, annexing expenses for the agreements with all nine counties total $4,454,470.18, compared with an approved not to exceed amount of $7,862,000.
Pursuant to this proposed board action, the Hennepin County Sheriff’s Office is seeking approval to amend current Agreements with Washington, Carver, Chisago, Wright and Scott counties, extending the end dates from December 31, 2026 to December 31, 2027, and increasing the original not to exceed amount of $5,933,000 by $6,126,613, for a new combined not to exceed amount of $12,059,613.
The proposed amount does not represent an anticipated expenditure level, and actual utilization is expected to remain below the fully authorized amount. The amount was intentionally set at a level sufficient to accommodate contingencies and unforeseen operational circumstances that may necessitate expanded reliance on external detention capacity. Funding to support these agreements is included in the approved 2026 Sheriff’s Office budget ($1,712,500) and will be incorporated into the County Administrator’s proposed 2027 budget.
The counties will provide secure custody, care, and safekeeping of Hennepin County detainees in their jails or correctional facilities. This includes providing the same level of medical care and services provided to their detainees.
