BE IT RESOLVED, that the County Administrator be authorized to negotiate Agreement PW 49-43-26 with the City of Rogers to establish county and city responsibilities for the jurisdictional transfer of County State Aid Highway (CSAH) 150 (Main Street) between CSAH 159 (Territorial Road) and CSAH 81 (County Road 81) to the City of Rogers, at an estimated county cost of $2,225,000, county project (CP) 2201142, a subproject of capital project 2201100; that following review and approval by the County Attorney's Office, the Chair of the Board be authorized to sign the agreement on behalf of the county; and that the Controller be authorized to disburse funds as directed; and

BE IT FURTHER RESOLVED, that the County Administrator be authorized to negotiate Agreement PW 54-43-26 with the City of Rogers to establish county and city responsibilities for the jurisdictional transfer of Fletcher Lane (County Road 116) between Valley View Terrace and CSAH 159 (Territorial Road) to the City of Rogers, with no county cost, CP 2021000; that following review and approval by the County Attorney's Office, the Chair of the Board be authorized to sign the agreement on behalf of the county; and 

BE IT FURTHER RESOLVED, that the road described as follows, to-wit: beginning at the junction of Main Street and Territorial Road, thence continuing along the centerline of Main Street northerly a distance of approximately 1.19 miles to the junction of Main Street and County Road 81 and there terminating, be and hereby is, revoked as a Hennepin County State Aid Highway subject to the approval of the Commissioner of Transportation of the State of Minnesota. 

BE IT FURTHER RESOLVED, that the remnant County Road 116 (Fletcher Lane) segment described as follows, to-wit: beginning at the junction of CSAH 159 (Territorial Road) and Fletcher Lane, thence continuing along the centerline of Fletcher Lane southerly a distance of approximately 0.13 miles to the junction of Valley View Terrace and Fletcher Lane and there terminating, be and hereby is, revoked as a Hennepin County Road.

BE IT FURTHER RESOLVED, that the realigned County Road 116 described as follows, to-wit: beginning at the new junction of CSAH 159 (Territorial Road) and the Fletcher Bypass (CSAH 116), thence continuing along the new roadway centerline southwesterly a distance of approximately 0.15 miles to a point on existing County Road 116 (Fletcher Lane) and there terminating, be and hereby is located and designated County Road 116.

Background:

The county and City of Rogers have collaborated to pursue a jurisdictional transfer of Main Street located between CSAH 159 (Territorial Road) and CSAH 81 (County Road 81). This segment of roadway has been identified in the long-range vision of the county’s 2040 comprehensive plan as satisfying conditions for jurisdictional transfer, is consistent with proper jurisdictional hierarchy, and aligns with the construction and opening of the Fletcher Bypass project.

In 2025, the county entered into Agreement PW 35-43-25 with the City of Rogers for cost participation and maintenance responsibilities relating to the design, right-of-way acquisition and construction of Fletcher Bypass (County State Aid Highway/County Road 116), (Resolution 25-0307). The transfer of approximately 650 feet of Fletcher Lane to the city is prompted by construction of the new Fletcher Bypass, which departs from the Fletcher Lane corridor and proceeds northeast along a new alignment before connecting to CSAH 81. This roadway realignment results in a segment of Fletcher Lane no longer serving as part of the county roadway system, making its transfer to the city appropriate and consistent with jurisdictional planning.

Proposed Agreement PW 49-43-26 stipulates that the county will pay the city a total of $2,225,000 as a cash equivalent to provide an approximate 15-year roadway service life, on the Main Street segment being transferred, consistent with the County’s Jurisdictional Transfer Policy (Resolution 18-0259). Proposed Agreement PW 54-43-26 has no county cost in recognition of recent upgrades as part of the Fletcher Bypass project and a recent pavement preservation project providing a 15-year roadway service life. Upon the execution of the agreements, the city will assume all jurisdictional and maintenance responsibilities of the roadways. 

Funding is available in CP 2201100 - Cost Participation & Partnerships 2024-2028, with expenses tracked in its associated subproject CP 2201142.

 

Current Request: This request seeks authorization to negotiate and execute the following agreements:

 

                     Agreement PW 49-43-26 with the City of Rogers to establish county and city responsibilities for the jurisdictional transfer of County State Aid Highway (CSAH) 150 (Main Street) between CSAH 159 (Territorial Road) and CSAH 81 (County Road 81) to the City of Rogers, at an estimated county cost of $2,225,000, CP 2201100; and

                     Agreement PW 54-43-26 with the City of Rogers for jurisdictional transfer of Fletcher Lane between Valley View Terrace and Territorial Road, with no county cost, CP 2021000.

 

Additionally, this request seeks to revoke CSAH 150 (Main Street) as a County State Aid Highway between CSAH 159 (Territorial Road) and CSAH 81 (County Road 81), revoke the remnant segment of County Road 116 (Fletcher Lane) as a County Road between CSAH 159 (Territorial Road) and Valley View Terrace, and designate the new roadway segment between the CSAH 159 (Territorial Road) and CSAH 116 (Fletcher Bypass) intersection and a point on existing County Road 116 (Fletcher Lane) approximately 0.15 miles to the southwest as County Road 116.

 

Impacts/Outcomes

This project supports the county’s 2040 Comprehensive Plan through the jurisdictional transfer of the identified roadways from Hennepin County to the City of Rogers.
