BE IT RESOLVED, that the County Administrator be authorized to negotiate and execute Agreement PW 26-17-25 with the City of Plymouth and Three Rivers Park District for cost participation and maintenance responsibilities relating to multimodal and safety improvements (project 2850700) and fiber optic conduit system improvements (project 1006393) along County State Aid Highway 73 between Sunset Trail/Zachary Lane and South Shore Drive/10th Avenue in Plymouth, at a county cost not to exceed $1,000,000 for project 2850700 and an estimated county cost of $60,000 for project 1006393; that upon review and approval by the County Attorney’s Office, the Chair of the Board be authorized to sign the agreement on behalf of the county; and that the Controller be authorized to disburse funds as directed; and
BE IT FURTHER RESOLVED, that the 2025 capital budget for project 2850700 be increased by $25,000 with funding provided by the Transportation Advancement Account - Active Transportation.

Background:
The City of Plymouth, in coordination with Hennepin County, the Minnesota Department of Transportation, and Three Rivers Park District, is leading a reconstruction project on County State Aid Highway 73 generally between Sunset Trail/Zachary Lane and South Shore Drive/10th Avenue. The project, which is beginning construction in 2025, includes the following multi-modal and safety improvements with new county-owned fiber optic systems:
• Realignment of County State Aid Highway 73
• Accessibility and signal upgrades
• Roundabout
• New regional trail
• Storm water/drainage improvements
On January 28, 2025, the county board authorized the county administrator to negotiate Agreement PW 02-40-25 (State Contract No. 1058416) with the Minnesota Department of Transportation, the City of Plymouth, and the Three Rivers Park District for cost participation and maintenance responsibilities relating to multimodal and safety improvements and fiber optic conduit system improvements along CSAH 73 (Resolution 25-0023).
During the negotiation of Agreement PW 02-40-25, the state requested a separate agreement with the county, which resulted in:
1. Removing the county’s cost participation and maintenance for the multimodal, safety, and fiber optic conduit system improvements from Agreement PW 02-40-25; and
2. Adding the costs for signal replacement to Agreement PW 02-40-25.
At the same time, the parties decided to create another agreement, PW 26-17-25 between the city, county and park district, for the multimodal, safety, and fiber optic conduit system improvements.
The changes between the two agreements will result in an increase to the county’s cost by $25,000 for the signal replacement. To account for the cost increase, staff recommends that the capital budget for project 2850700 be increased by $25,000.
Current Request: Authorize the County Administrator to negotiate and execute Agreement PW 26-17-25 with the City of Plymouth and Three Rivers Park District for improvements along County State Aid Highway 73 between Sunset Trail/Zachary Lane and South Shore Drive/10th Avenue in Plymouth. Agreement PW 26-17-25 will incorporate two county two projects:
• Project 2850700 for cost participation and maintenance responsibilities relating to multimodal and safety improvements, at a county cost not to exceed $1,000,000.
• Project 1006393 for fiber optic conduit system improvements, at an estimated county cost of $60,000.
Also, this request is to increase the capital budget for project 2850700 by $25,000, with funding from the Transportation Advancement Account - Active Transportation.
Impacts/Outcomes: This project supports the county’s Mobility 2040 goals, climate action, and disparity reduction efforts by improving accessibility, safety, and mobility for multi-modal transportation users.
