BE IT RESOLVED, that the County Projects identified below are necessary for the safe use and travel of the public on the roads associated with each project and that the County Projects identified below are for a public purpose and for public use; and

BE IT FURTHER RESOLVED, that the use of the “quick take” procedures of Chapter 117 of Minnesota Statutes is necessary and expedient; and

BE IT FURTHER RESOLVED, that the County Administrator be authorized to acquire fee title and/or easements necessary for the completion of the transportation projects identified in this request by negotiation or condemnation and declare as surplus and offer for sale any fee title or easements previously acquired for the projects described herein; that upon review and approval by the County Attorney’s Office, the County Administrator be authorized to sign purchase agreements and deeds accepting the acquired fee title or easements on behalf of the county; and that the Chair of the Board be authorized to execute deeds and all other conveyance documents relating to said acquisitions, declarations and sales on behalf of the county.

Background:

Transportation projects may require the acquisition of property rights in fee title or easements to accommodate the public improvements. While most acquisitions have modest or partial impacts, there are occasions when an entire property is required.

 

Transportation projects may also involve realignments in which right of way is not needed for county purposes. After construction, this excess right of way may be sold as surplus property.

 

Current Request:

This request is to authorize the County to acquire all necessary property interests and to declare as surplus, dispose and divest of any fee title or easements related to the County Projects (CPs) identified along the following County State Aid Highways (CSAHs):

Impacts/Outcomes:

Approval of this request will allow for the timely acquisition of property interests to construct transportation improvements and dispose and divest of excess right of way no longer needed for county use.
