BE IT RESOLVED, that the Hennepin County Board of Commissioners authorizes negotiation of Amendment 12 to Agreement A177882A (Counties Transit Improvement Board Capital Grant Agreement #02-2017-01) with the Metropolitan Council for the Blue Line Extension project (Bottineau Light Rail Transit, Capital Project 1005877), as assumed and amended by Hennepin County, extending the grant activity period from May 31, 2023, to July 31, 2023, with no change in the not to exceed amount, and approving a revised grant project budget and disbursement schedule; and

BE IT FURTHER RESOLVED, the Board authorizes the Chair to execute Amendment 12 after review and approval by the County Attorney’s Office; and

BE IT FURTHER RESOLVED, the Board authorizes the Controller to transfer and disburse funds as necessary to carry out the intent of this Resolution.

Background:

Resolution 17-0207, on June 13, 2017, approved the assumption of certain not-yet-paid funding commitments for the Blue Line Extension project (Capital Project 1005877), the assumption of the 2017 Counties Transit Improvement Board (CTIB) Capital Grant Agreement (CTIB #02201701/Met Council #17I001/County #A177882A) with the Metropolitan Council for the Blue Line Extension project, and the imposition of the 0.5% Transportation sales and use tax and $20 motor vehicle excise tax that is the source of funds for Hennepin County contributions to the project. 

Through these and other actions, Hennepin County agreed to take responsibility for the remainder of project funding formerly committed by CTIB and the remainder of funding formerly anticipated from the State of Minnesota. Agreement A177882A set the maximum grant amount at $66 million. Resolution 17-0493 R1, on November 28, 2017, approved Amendment 1 to Agreement A177882A, authorizing technical and conforming changes to reflect the county becoming the grantor under the assignment. This Amendment authorized the county to provide $11,087,084 in addition to the maximum grant amount of $66 million and extend the contract period to April 30, 2018. 

Resolution 18-0150, on April 24, 2018, approved Amendment 2 to Agreement A177882A. Amendment 2 extended the contract term to September 30, 2018, and provided that $19.8 million of the Maximum Grant Amount would be paid with Hennepin County funds, with the understanding that the County would use CTIB funds to pay the remainder. This commitment of County funds was in addition to the $11.1 million of County funding provided through Amendment 1, for a total commitment of $30,887,084 in Hennepin County funds in addition to funds provided by CTIB. 

The board subsequently authorized the following additional amendments to Agreement A177882A, each of which extended the contract end dates as shown, with no change in the Maximum Grant Amount, the County funding commitment, or the contract not to exceed amount.

                     Amendment 5: through January 31, 2020 (Resolution 19-0219)

                     Amendment 6: through October 31, 2020 (Resolution 20-0023)

                     Amendment 7: through June 30, 2021 (Resolution 20-0389)

                     Amendment 8: through February 28, 2022 (Resolution 21-0186)

                     Amendment 9: through November 30, 2022 (Resolution 22-0056)

                     Amendment 10: through March 31, 2023 (Resolution 22-0432)

                     Amendment 11: through May 31, 2023 (Resolution 23-0125)

This Resolution would authorize negotiation and execution of Amendment 12 to Agreement A177882A, extending the contract end date, to July 31, 2023, again with no change in the Maximum Grant Amount. Pursuant to Agreement A177882A, the county has paid a portion of project expenses since January 1, 2018, totaling $16.6 million through April 2023. All CTIB funds were fully paid as of September 2022.

 

Current Request: Authorization to negotiate Amendment 12 to Agreement A177882A with the Metropolitan Council for the METRO Blue Line Extension LRT Project (CP 1005877) engineering phase activities, extending the contract period to July 31, 2023, with no change in the not to exceed amount, and approving a revised grant project budget and disbursement schedule. The amendment will allow for continued work on the METRO Blue Line Extension LRT project.

 

Impact/Outcomes: This action supports the county’s disparity reduction efforts by investing in infrastructure that gives people transportation choices and access to housing, jobs, schools, medical facilities, and recreational areas.
