BE IT RESOLVED, that pursuant to set-aside authority authorized under Minn. Stat. § 471.345, Contract FC00000079 to KMS Construction for the HSB-9 Adult Representation Services Remodeling project (Sub-Project 1009870, Capital Project 1006402), in the amount of $1,844,159 be approved; that the Chair of the Board be authorized to sign the contract on behalf of the county after the performance and payment bonds have been properly executed; and that the Controller be authorized to disburse funds as directed.

Background:
History:
Adult Representation Services (ARS) became a department in 2018. Staff provide legal representation and wrap-around social services to clients in the areas of child protection, child support contempt, guardianship, housing and mental health commitment. Most staff are designated as on-site employees because they provide direct service to residents and appear in multiple courthouses downtown.
ARS has outgrown its current space on the 10th floor at HSB. Employees are temporarily using space at the 701 building awaiting expanded space at HSB. The 9th floor at HSB provides contiguous space to accommodate the department and its projected immediate growth.
Using the set-aside authority enables the county to have a portion of the construction work delivered by an Emerging Small Businesses Enterprise (ESBE) general contractor from the Department of Community Corrections and Rehabilitation's (DOCCR) Community Productive Day Construction Partnership Program. General contractors are qualified for this program based on their demonstrated success employing and training ex-offenders. The selected general contractor will be required to employ and provide on-the-job training to probationers during the performance of their contract for not less than 10 percent of the contract's total labor hours.
Through a best value procurement process, a Request for Proposals was released to the approved set-aside general contractors on March 14, 2023. Three (3) proposal was received. Based on the results of interviews with the proposers’ key staff, KMS Construction, received the highest score, based on its cost, written submittals, and interview. Staff believes that KMS Construction represents the best value to the county and recommends that it be awarded this contract.

This is a request to award Contract FC00000079 to KMS Construction for the HSB-9 ARS Remodeling project, $1,844,159.
Impact/Outcomes:
This project will improve / upgrade needed on-site employee workspace and space for staff to meet with clients. The board action request aligns with Hennepin County disparity reduction efforts by ensuring that clients served by ARS, who are mostly Black, Indigenous and People of Color, have needed access to their legal team. It also ensures that the legal team has appropriate and confidential spaces to facilitate the representation.
